Court Finds Affliate Marketing Network Liable for LeanSpa

The U.S. Court of Appeals for the Second Circuit upheld a lower court ruling holding LeadClick Media, LLC liable for $11.9 million for recruiting affiliate marketers that used fake news sites to drive internet traffic to the LeanSpa, a deceptively marketed weight-loss supplement. It is the first court of appeals decision holding the operator of an affiliate marketing network liable for deception by third-party marketers. The Court found that LeadClick knew that the news sites were phony and actively participated in creating their content.
